Gunns Supreme Court bid dismissed

Outcome of the directions hearing, 2 February 2012, in the matter of TCT vs Gunns Ltd


Today the Supreme Court of Tasmania dismissed Gunns Ltd’ s application for a stay or postponement of the case and the TCT now expects the case to proceed to trial as soon as possible.


The court also set down deadlines for the TCT and Gunns to provide a list of all documents which will be tendered in evidence at trial - after which a trial date/s will be set by the court.


If these requirements are met by both sides and with no further interuptions the TCT is hopeful that the case may go to trial in early April 2012.

Tasmanian Conservation Trust Supreme Court challenge to the Tamar Valley pulp mill permit – next hearing 2 February 2012


On the 2nd February 2012 at 9.15 am a directions hearing will be held in the Supreme Court of Tasmania in the action of the Tasmanian Conservation Trust Inc verses Gunns Limited.


The TCT initiated this action on 25 October 2011 in order to seek a court determination that the permit for the proposed Tamar Valley pulp mill had lapsed because the proponent had failed to meet the permit condition that the project be substantially commenced by the end of August 2011.


At the 2nd February 2012 hearing, the TCT is seeking the courts approval for a timetable to ready the case for hearing. This will establish dates by which the TCT and Gunns are to provide the court with a list of documents which will be tendered in evidence at trial. The TCT has also requested that once this list of documents has been received by the court that the action be listed for trial in Hobart.


On 23 November 2011 Gunns Ltd made an application to the Supreme Court for a stay or postponement of this action but on 16 January 2012 notified the TCT of their intention to have the stay application dismissed. The TCT expects the stay application to be dismissed by the court at the 2 February hearing, enabling the case to proceed to trial as soon as possible.









Gunns withdraws legal challenge

The Tasmanian timber company Gunns has abandoned an attempt to have a case surrounding the permits for its $2.2 billion pulp mill thrown out of court.

The Tasmanian Conservation Trust launched a legal challenge last October based on an argument that the permits for the Tamar Valley mill had lapsed.

The permits required Gunns to have started substantial work on the project.

The trust is arguing that is not the case.

Last November, Gunns tried to put a permanent stay on proceedings but has withdrawn the application.

The case is now likely to go to trial in April.
