I'm just looking at it from their side. Reverse the roles. If NKP were in ARMs position. Would you think it fair that someone can start mining your resource before a judge has ruled on an open case?
At the moment its a moot point. Their is no application for injunction. And their is no open case to lay grounds for an injunction. But that can change quickly.
I would assume it doesn't matter. Because NKP aren't ready anyway. And preference would be for a speedy hearing to determine rightful ownership. So by the time we are ready to mine the mess would be sorted. But who knows. Its just speculation.
I don't know if PAJA 180days only applies to prospecting rights or also mining rights. But surely their is a time limit for ARM to layout all the cards. It cant go on forever?
Too much uncertainty. Sp can't go up until a JV or definitive resolution to rights issue. hopefully both.
