Shaneshanes...put simply, yes there is a law that states bnym or any other market makers cannot buy shares on aussie market until official list date is announced.
Here is what MR said to me via email:
"The NASDAQ hasn't given us an actual listing dates yet. We have been finally cleared by the SEC for a listing that is what the recent announcement was about and as you can understand we can't comment until we receive the listing date.
Once this date is given the market makers lead by Deutsche Bank, Noble and Aegis may begin purchases as they deem fit to demand in the US. No new shares will be issued they will be transferrable from the asx"
