the reasons for judgements makes reference to "the affidavit of Evan Anthony Stents". The judge says they are contentious (para 74) and he did not need to refer to them in making his orders or address the objections to. The objections would have to be from H/Q.
Does anyone have an information on Evan Anthony Stents? The only person I can find is described at
http://www.hwlebsworth.com.au/expertise/automotive/features/our-team/item/77-evan-stents.html
Stents is described as "a partner of HWL Ebsworth and has acted in a broad range of commercial and insolvency disputes in superior courts throughout Australia"
Since the judge reached decisions without reference to the affidavit. My opinion of this is that AGS has further expert 'evidence' that hasn't been tested yet.
Looking at it from AGS's perspective I quite liked the judgement. The judge appears to accept that they 'know' something but knowing and proving it two entirely different things in court cases!!!
