Good post. But as for your comment re: "I'd say that if someone tried to takeover BCI and FMG didn't like it. That there would be a clause in the NIOJV that FMG holds the right to refuse enter on their infrastructure by another third party."
If you check out the ASX release in Jan 2011 regarding the Regent takeover (http://asx.com.au/asx/statistics/displayAnnouncement.do?display=pdf&idsId=01143335) it specifically says that the takeover does not affect any of the contracts.
