Are you saying that CTP should have let that one go through to the keeper? If Askin and co are litigation adverse, why are they continuing the legal action (see latest quarterly report)
2. JH commences litigation against the company due to alledged wrongful dismissal.
If JH hadn't been terminated in the manner he had it would not have been necessary to take legal action to challenge the dismissal. If you were in his position, do you you honestly tell us you would be sanguine regarding your dismissal? Do you really think you'd just shrug and cop it on the chin. The legal action was a response to the actions of the board.If they hadn't terminated him, he wouldn't be challenging it.
3. CP has action against the company, with JH conspiring with CP company against CTP.
Rubbish. There is absolutely no evidence of JH "conspiring" with CP. He provided an affidavit in respect of a material fact, which was that the discussions between PN and the board while he was MD were never communicated to him. I have no doubt that the discussions between PN and the board lie at the heart of Askin's comments in the board meeting on 12/2/12 and provide corroboration to JH's account of what occurred.
Interesting how you have glossed over Askin's penchant for litigation "we will defend and oppose the application vigorously" on every second announcement instead of seeking mediation in the first instance.
Clearly this fight is such that neither side will back down and both will use every legal resource at their disposal to destroy the other. There can be no conciliation, this is now winner take all IMHO.
