Although anything is possible, I can't see that happening either.
Reason being that if that was to be allowed, and in the cash strapped position CTP is finding itself at the moment, it could spell disaster for the thousands of shareholders invested in the company. They (CTP) simply hasn't got the money to come up with, and buy those shares back from Patterson's clients. The only way would be for CTP to buy them back from Pattos and hand them over to CP.
But then, what would Pattos do???
On the other hand, I agree with you that the Courts may grant leave for CP to seek alternative ways of action and with the view of possible compensation.
