The merger deal is revised after Nabi finished its Self-Tender Offer transaction. Those Nabi shareholders who sold their Nabi shares in the tender offer based on the original merger terms, now may feel being disadvantaged, and may seek compensation.
The question is: Will the new Biota company be liable for such compensations, if any, that arise from shareholder class action?
