PIF is under Corporate law ,at that time, a totally different entity from Octavier .The Directors of Octavier,( not the PIF Directors) steal money from PIF .to pay out Fortress loan .Who is to blame; PIF investors or Octavier Directors ? RBOS should have been instructed to sue Octavier for the loan, by any competent RE .
I still remember a good friend of mine who was gloating how he got a car at an absolute bargain for ten grand . Two months later the police arrive at the doorstep , stolen car . He ends up with no car and no money and nothing in the world he can do to get his money back, except perhaps sue the perpetrator who does not have a brass razoo to his name .
