If you are right and she NOW is considering the arguments till november the 8th and comes to the point, that the suspension of TOL could be removed, than she allready will be at a point where the whole judicial review is over and makes no more sense. So removing the suspension on november the 8th AND further judicial review makes no sense. If you say: on november the 8th suspension will be removed AND judicial review is over - that could be (in my view pretty unlikely).
But what you expects makes no sense.
