As a lawyer, the advice you would normally give a company/person accused of misleading conduct is that the likelihood of any action arising would be negligible unless it resulted in material loss. Lynas no doubt concluded that despite what arguably were misleading updates about progress with the LAMP, as long as the TOL was not approved, not issued or not suspended, no investor would suffer any material loss as a consequence of its statements.
