The 40% figure was DLS arbitrarily self imposed target upon which the 28.5c offer was made conditional... Which they then waived after receiving commitments that ensured they already had the 40% - go figure! No, DLS can only buy at a price holders are willing to accept. And I think we all know if Flax/Juniper are linked as stated in quarterly, that's over $1
