regardless how you want to twist it the fact remains once in detention the government has a duty of care towards those being detained.
Just as the government has a duty of care towards prisioners in prison even though it is the persons own illegal actions that put them in prision in the first place.
Argue this fact all you like
Agree or disagree with it
But
It is not going change the reality of the situation
