the duty of care has not been failed because the duration of the detention...
..it is the policyt and they entered the country illegally knowing that the policy wiould apply to them.
Nor because of the actions of the protestors!
I'd agree....if the govt had stood by and watched the protestors or rioters or mouth sewers and did nothing and in so doing exposed the child to thier wanton acts and did nothing to stop it
...then you'd have a case
But if the govt acts in a measured and valid manner in dealing with these issues...
...again the duty of care has not been breached.
Your arguement only holds water if you believe there should be no detention centres and no policy of detention.
