    You could be right - but why I hope you're not was best expressed in a WA govt brief I read this afternoon. It was written for small business but applies equally, if not even more so, to big business.

    "The difference between a court resolved dispute and a mediated settlement can be summarised as follows ..

    "A court finds in favour of one party against the other, who can be described as the LOSER. In a mediated settlement it is entirely possible for there to be two WINNERS who, because of the skill of the mediator, may be able to continue in the business relationship often on even better terms than those which existed before the dispute arose."     Those other imperatives of "face" that apply in many cultures would also apply in our battle of the titans. A resolution wherein no one loses face must surely be the win-win we need for shareholders and egos alike. ..

    Perhaps we could also learn something from that other famous BB court case that is still ongoing I believe (copied from a foe website :-)
