Doesn't disclosure also apply the other way - OBL submitted the documents in December, but FMG didn't exit the deal until the final date in January - and OBL didn't know until that date. Obviously if FMG knew before the final day, wouldn't they so be bound to disclosure rules also. Or did they only suddenly decide on the day and thought - "suppose we better call up Neil". According to the first announcement the signing was expected in 5 days. That didn't happen and since OBL submitted docs, presumably the deal still on the table buyt delayed for a reason we don't know. As for the month that elapsed until January, who was the cause? But presume FMG since they pulled the plug. Difficult for OBL to be blamed for disclosure considering the confidentiality clauses surrounding the negotiations and especially since they believed the deal was on, but FMG exited. If there is a disclosure issue then should be aimed at FMG. There is also the question as to why OBL released the statement in November which was never put up on the FMG site, nor any ASX announcements on their site similar to the OBL announcement. Considering the announcement had material impact on FMG, why was there no mention on their site either under ASX announcements or under their news listings? Or was the entire November announcement content never going to be achieved? In other announcements from companies involved in such contractual agreements I have typically seen each company issue announcements. So something still does not smell right.
Has anyone managed to get in contact with Neil in regards to any futher information to date?
