You stated a case where the insurance company tracked a person down and successfully sued them - THAT IS THE POINT MAGOO
The insurance company successfully sued the person - in other words they proved the person was at fault
A person is not at fault on the say so of an insurance company
A person is not at fault because their client making the claim states the other person was a fault.
A person is not at fault in an accident regardless how blatant the fault maybe until
They admit fault
They are proven to be at fault in court.
And until fault has been admitted or proven no liability exists for any damages.
You seem to be adding 2 and 2 and saying the answer is 5, leaving a vital part of the equation out
And care to explain how fault can be proven in a accident that you where nowhere near at the time
Unless you lent the vehicle to a person who you knew was drunk, did not have a licence or by some other means was unfit to drive
Or you new the vehicle was unraod worthy
