"My beliefs are that a settlement should be reached before going to a Judge. That is why I persist with representations."
Fair dinkum maxw You would have a better chance of getting an out of Court settlement with a strong Lawyer representing you, than getting any money out of it, if ASIC will get going.
How many years does it take for ASIC to get cracking, then prepare a case, and then getting ready to go to Court.?? I wonder if you and I and many others here will still be alive by then.
IMHO, most of the time that ASIC gest involved, (If they ever will that is), all they are looking for is for their costs to be covered, and then, if they are lucky they may get a fine to be paid by the defendant approved. Now who do you think will end up with the fine if there is one to be paid.??
On the other hand of the scale, there are Lawyers out there that specialise in these sort of things as it is their major bread and butter. They will study the case in full, and, if they thing there is a chance of winning they will go ahead. And the reason is, that if they loose they will get nothing out of it either.
I do think that there is something in there that you are not happy to proceed with. And I am wondering if it was what I have told you sometime ago from my experience with them in the past, and what they've told me.
Anyway maxw, good luck with it. If you are happy to continue down that path even after you have realised that it got you nowhere fast, so be it.
