re: nickd003_where does it come from Nickd003,
I totally understand where you are coming from with your question “what is the date of this execution???” in reference to: ‘Kirke Securities obtaining sub-underwriting commitments in respect of the entire Offer within ten business days of the date of execution of the Underwriting Agreement…”

Looking at the prospectus “Proposed Timetable” dates, sections “5.3 & 5.4” and MOST IMPORTANTLY the ASX ann dated ‘22/09/05 $2.7m Fully Underwritten Rights Issue.’

My interpretation is that the date is gone.

Also interesting to note in section 5.3, 2nd para, the underwriter will be paid by the Compnay an underwriting fee of 5% of the amount of the Shortfall Securities…

    cheers

Ghost You wrote"Received a reply back from Greg Durack tonight ,As far as he is concerned Kirke Securities aree the underwriters , it is up to them to find sub underwriters "That is true but according to the Prospectus, the Underwriting is conditional upon Kirke Securities obtaining binding sub-underwriting commitments in respect of the entire Offer within 10 business days of the date of execution of the Underwriting Agreement. But what is the date of this execution??? Has it happened yet? This is what I want to know. Before I think of subscribing I want to be sure that this condition has been met and the offer will be fully underwritten. I cant seem to get an answer to this anywhere and I have not had a reply from Greg Durak in response to this question. Perhaps you can ask him this as he has replied to you.CheersNick D
