Just thinking aloud - the dispute between NKWE and ARM became public in 2011. From the article posted earlier ARM says Legal Proceedings have NOT begun..... So it's Sep 2013 and they're still trying to work out what they need to do to win this? Sounds like they may not have a case.


"But Mr Uys said yesterday that, so far, legal proceedings had not begun because the old order mining right was in the name of Amplats — not ARM. He said discussions had taken place between ARM and Amplats regarding the course of action to be followed."


2nd thought - given the miners pay disputes and strikes recently at Modwika, it would be in the best interests of SA Government and DMR to have some healthy competition in the area, compared to the current monopoly held over the community by ARM/Anglo.

Hmmmmmm. -> Decision from DMR should naturally be in favour of NKWE.

It appears long termers have been burnt so badly that when it looks like things are finally falling into place, they don't want to make this trade again.
