    A set back for epi-lift (one of NAL's competing products for epi-lasik)?

    Summary...

    Initial sales of the EpiLift and LasiTome systems were in Europe and certain countries in which the products had received required regulatory clearance for marketing. Marketing of the EpiLift System in the United States began in September 2004, following receipt of 510(K) clearance for marketing from the United States Food and Drug Administration ("FDA").

    Revenues from both the EpiLift and LasiTome Systems were generated through both the initial sale of the respective devices and accessories and through recurring sales of disposable separators or blades.

    Certain disputes arose between the Company and Gebauer, and in October of 2005 the Company and Gebauer entered into a settlement agreement in which the parties mutually released each other from any liability.

    In addition, the parties agreed that the Manufacturing Supply and Distribution Agreement previously entered into by the parties on April 27, 2004 was terminated, and that there were no further obligations by either party under that Agreement.

    Thus, the Company no longer sells the EpiLift or LasiTome products.
