I understand Biota has a world (ex USA) patent until 2011, with the USA patent until 2014.
These Indian companies are substantial entities and I am sure will honour any royalties/patents due, they would not risk their current business by producing without licence.
It is also my understanding that GSK cannot licence to a third party without Biota's approval, therefore the current 7% royalty could be lower or higher depending on what Biota agree to.
It is obviously in Biota's interests to agree to third party licencing as it is more royalty $ to them, but very importantly one would expect GSK will have to be more open with Biota regarding current orders if the dialogue for Biota's approval was to occur. It may also bring forward a potential settlement.
