It is not open to interpretation. The NRC is the law what they say is how BLR must do their business.
Who really knows what will come out of the Abalation machine, maybe it is non radioactive. Maybe it will deliver material which is considered to have a high enough concentration to be registered as radioactive (hence the need for SML)
Please don't over simplify this potentially revolutionary process and say its fine when you obviously don't know more than the NRC.
