Yes, i think access to 3D could could be a grey area. Other problem is a takeover may take up to 6 months or so if CTP fight. What is STO going to do then?.. as drilling Mt Kitty may work against them. But if they don't drill then they may be in breach of some contract (hopefully RC has this tied up properly). it would get messy for STO to perform a takeover priot to Mt Kitty being drilled. It may still be a duster. I don't think it will happen. STO may make a low-ball offer after Mt Kitty if it does turn out to be a duster just to get the acreage.

ps. i hope that RC made STO & Total sign "standstill agreements" when they farmed in. I would hope that this was done as a basic requirement... i would think that was Farm-in101
