My second point, if you read it more closely, stipulates that yes SMM are in contravention of a clause in the Mines and Minerals Act and by s 71 of said Act the Minister of Mines has the legislated granted power to strike down such grants. However, SMM could potentially argue that because Axiom was granted an LOI whilst one was already active, it could leave Axiom's LOI to be deemed invalid.

So my second point is not "called land banking", it's in fact an entirely different concept to land banking. But I am well aware of the clause that SMM violated thus allowing the Minister to activate his s 71 power, thanks again though!

Another point is that the s 71 power could potentially be outside of the scope of Executive power (relating to separation of powers). This is a real long shot though I think.
