    The criminal justice system so ill equipped to deal with justice that the situation is laughable.

    Having a system based on precedence means you will never be ruling based on what is best for society - only what happened before - when society and the nature of crime was different. As long as this is the case, the legal system will never hope to cope.

    and there are so many new tools available to the courts, methods of gathering evidence, methods of sentencing.

    IMHO almost a complete rethink is necessary to fix the situation. when 70% of all crime is committed by reoffenders, then why not simply remove the ability to reoffend?

    Parole is another stupid idea - seriously why should anyone get out early for any reason, ever?

    You mother is dying and you are in Jail? too f'n bad - you shouldn't have committed the offence to begin with.

    It's christmas - read above - too bad.

    the majority of the research demonstrates quite clearly that rehabilitation is ineffective - so why continue to flog a dead horse.


    so I wouldn't say magistrates are the dumbest people in the world, but i would say they are most out of touch with reality. and when they are making decisions about the welfare of the rest of us... that is dangerous.
