    The State Agreement Rules over everything else and the Greenies know this. They know they are not going to win this fight but want their 15 minutes of fame anyway.

    Part of the Australian Conservation Foundation Response on December 10 2013 was this:

    "The WA Department of Mines and Petroleum (WA DMP) lacks sufficient powers to regulate
    the industry"

    "In WA, unconventional gas development is regulated under the Petroleum and Geothermal Energy
    Resources Management (PGER) Act, administered by the WA DMP. This is concerning because the WA
    DMP lacks the powers required to appropriately regulate development. A 2011 report into regulation
    of gas fracking in WA found that that ‘there are no legal provisions in the [petroleum] Act that
    specifically pertains to the management of the environment in onshore petroleum activities’, and that
    while the DMP has a custom of requesting environmental management plans from proponents that
    these management plans are legally unenforceable. The DMP has no teeth, no head powers, and no
    ability to regulate.[18]"

    So lets get on with the main game, get fracking and get the gas flowing.
