I would have thought he's much better off serving the 3 months. By appealing this he's still got the issue hanging over him for the length of the appeal, more legal bills, and the likelihood of going to gaol at the end of it. Seems a tough argument to win that 3 months gaol is "manifestly excessive" for stealing $30k.
