1.VMS already have full permission to mine.

The mine can't be disallowed. If VMS loose the case the minister just reapproves the mine fixing up whatever he did wrong previously. Also following your logic of not wasting money by mining, then you'd also agree that buying all the equipment for the DSO plant before the appeal is decided is also a waste?
