A MAN who left a woman unconscious when he punched her in the face in a drunken nightclub brawl on Wednesday walked from court with nothing more than a fine.
Liam Moody escaped conviction for the attack on his young female victim that left her requiring extensive surgery.
The Melbourne Magistrates’ Court heard Moody was with friends when he bumped into a female friend, who was with a friend who started abusing him at CQ nightclub in October.
Moody tried to brush the woman aside but the court heard she persisted to attack him verbally before punching him in the face.
He then punched the woman to the head causing her to collapse on the floor.
The victim lost her front two teeth and required stitches and ongoing dental surgery and treatment.
Moody pleaded guilty to recklessly causing injury.
He received a $1500 fine without conviction.
George Balot, for Moody, said his client was severely affected by alcohol at the time and deeply regretted the attack.
“Although my client was initially struck by the female victim, he whole heartedly regrets his use of excessive self defense in a drunken setting under substantial provocation,” he said.
The magistrate accepted Mr Balot’s submission that the incident would not have happened if Moody was not affected by alcohol.
“My client is extremely grateful for not having a conviction recorded against him,” he said.
How can this be?? Very bad message. Wake up Magistrate
