Going by this article, Uber are using unlicensed vehicles and bypassing regulations to roll out their product in Sydney:

It is my understanding that in all jurisdictions, a vehicle needs to be licensed commercially as a hire car or taxi to carry passengers for payment.
It will be interesting to see how regulators in this country deal with Uber's disruptive practices of snubbing the lawmakers of this country.
