I reviewed the posts on the legalities from late december. CAZ are the registered owner, RIO seek an exercise of a discretion by the minister "public interest" 111A Mining Act This decision is only reviewable under the ADJR Act. If he has complied with the principles of natural justice they may not even have standing if this is evident from pleadings. If they do the court does not review his decision rather compliance with the decision making process. If there was a hearing at first instancce say in WASC, they would not get leave to the full bench or the HC. There is no wardens court appeals etc on this point. RIO have pursued this as it is there only hope and worth throwing a few dollars at. If RIO did get a hearing on the admin law point CAZ could apply as an interested party to be joined and seek that the matter be expedited
