It may be a bit simplistic but as I see it in relation to the ATO bill and MCC debt CFE will be better off than they are now whatever happens
If the court deem CFE are owed $80 Million then we get the $80M plus interest and pay the ATO and whatever penalties the court decides and keep the balance
If on the otherhand the court finds in favour of MCC and awards them the $80M then clearly there could never have been any tax payable so the ATO debt and any penalties relating to this debt could not be applied so the only tax dispute would be in relation to the Copper Co debt which was "only" timing issue.
Obviously it would be better to get the $80 Million but even if CFE dont they would get a nice tax refund from the $30 odd million we have already paid to the ATO.
Any other thoughts on the matter welcomed
