Just to update members on ASIC. I have not received any response as yet. My complaints included misleading statements in the Independent Expert Report, further misleading comments in Deloitte's response to my complaint on the IER, potential conflict of interest with Deloitte preparing the IER, and whether it is appropriate for Nexus to contact shareholders based on their votes submitted to Computershare.

I know that we have avalanched them with complaints, but ASIC is very aware of the deadlines. As the Scheme has not yet been scuttled, the deadlines still hold.

Regardless of the outcome of the findings, I feel obliged to continue a dialogue with ASIC and higher authorities, not for the sake of NXS, but to ensure a greater accountability for future Independent Experts' Reports. In my opinion, there is a fundamental problem of accountability of Independent Experts, and very little opportunity for them to be questioned, and these questions being arbitrated fairly and quickly.
