    I've had a bit of a look through the documents and dates on the following site and I think that we might be pleasantly surprised with an early ATO resolution. Check it out for yourself and make your own decision though.

    https://www.comcourts.gov.au/file/Federal/P/WAD88/2014/actions#;javascript:void(0);

    You will see that the Dispute Resolution was filed by CFE on 24 June 2014 (well before MCC resolution).

    You will see that the Taxation matter was filed on 16 April and appears to have had 2 hearings that have been adjourned.

    On the hearing date of the 24th of June the Orders say that:
    1. The matter be referred to mediation before a Registrar of the Court between 25 - 27 August 2014 (inclusive)
    And very interestingly they also say:
    1. Not less than 21 days before the date of any mediation conference the parties confer with a view to determining what if any steps need to be taken to facilitate the mediation.
    So if the parties must meet not less than 21 days before the 25th, that makes it before the 4th of August, so anytime between 14 July (MCC Settlement) and 4 August would satisfy the court order.

    If the CFE Board are going to meet within two weeks to decide on a Dividend or a Capital return does that mean they plan to meet with the ATO prior to making the decision, I think it could.

    SO what I am saying is that CFE and the ATO could be speaking now and resolving the ATO issue and then it will be much easier to make a decision on the Dividend and Capital return - within the next two weeks.

    My guess, so I am holding and not selling at these rediculously low prices. Also considereing China's growth is up 7.5% it could mean a resurgence in Iron Ore prices. Never know what is going to happen - do we?
