Thousands of down syndrome babies are aborted every year and no body makes a fuss about that. Normally, expecting couples who are at risk of producing a downs syndrome baby get tested and if the test proves positive the pregnancy is terminated. This is standard practice. So if the surrogate was tested and refuses to abort the fetus then I suppose she has to take responsibility for it because she has been paid to have their baby and they have a legal right to abort a fetus with down syndrome.
