As I understand matters:
TE will deliver a tin-tantalum MINERAL concentrate to SmelterCo;
SmelterCo will smelt the stuff producing tantalum glass and tin metal;
The tin will be sold to whoever; and
The tantalum glass will be sold to HCS as per the offtake agreement.
There is no breach of contact here.
Further, I am sure that HCS are fully in the loop.
