Commission releases consultation paper on proposed changes to Chorus'
regulated UBA
The Commission has today released its external legal advice as part of its
investigation into a complaint from Spark relating to the requirements for
delivering a basic regulated copper broadband service. The Commission is
consulting on the advice and has not offered any further views.
While we are still assessing the advice released today, it continues to
highlight the complexity of today's regulatory environment and seems to make
it harder for Chorus to deliver better broadband performance and more choice
to RSPs and their end users.
In developing the proposals that the advice comments on, Chorus has taken
into account all previous regulatory guidance and consulted widely. The
Commission's legal advice appears to be inconsistent with the regulatory
guidance that is available.
Chorus looks forward to responding to the legal advice on 18 September 2014
and will consider releasing legal advice in response.

submissions in relation to this process can be found on the Commission's
website.
