We can expect a lot of irrelevant noise and light from the barristers during the case but really the most important points will be are : -

What were MELs obligations under the licence in relation to community consultation? and

Whether the OCSG legally suspended the licence?

And I think mumbly has pointed out earlier on that it is very likely that OCSG screwed up the licence and MEL in fact had no particular community consultation requirements under the licence.

So the governments case should fall over on the first point irrespective of all the other noise. And the governments case on the second point is very shaky.

We can only hope that Henderson and our lawyers are of sufficient standing to clearly make these points and not be sidetracked by the "1000" well or Kingfisher stories.
