If I make a legitimate takeover offer for BHP, they must inform the ASX and shareholders of the offer. Even though I may not have the loose change this week they can't dismiss the offer as being a factor that won't influence share price. A pending court case is the same principal. Any application, regardless of how trivial, if it has the ability to influence share price in anyway whatsoever then it should be disclosed. ASX needs to fix that area of governance.
