Great big thank you to Seamisty.. how much I agree with this 'Today the High Court unanimously dismissed an appeal from a decision of the Full Court of the Federal Court of Australia. The High Court held that the responsible entity of a managed investment scheme ("Wellington") was not authorised by the scheme constitution to distribute scheme property in specie to unit holders'.
I think there should/will be some serious repercussions from this result!!! The PIF lost millions upon millions of $ as a direct result of Wellington Capital Ltd handballing us over to ARL!!! Where to from here I wonder?
