Look, the ACT is so obviously completely at odds with the whole of the rest of western society with this issue that who knows what would be done. My first call would be to the parents of both children to see if they are fit to be looking after the kids.
But my post wasn't in any way meant to defend what some muslims do, just to point out that our own back yard needs a bit of cleaning up too.
IMO it should be 16 across Australia, no statutory defences. Up to the judge to determine if there really were mitigating circumstances (e.g. male, 21, girl 14 but looked 17, had borrowed her sister's driving licence and car for the evening without her knowledge....).

My obvious point was that without that statutory defense BOTH would be charged. Swap the sexes around so it's a 10yo girl with a 12yo boy and alot of people would be arguing it should just be the boy charged. There's good reason for such statutory defenses.
