The plant is clearly being used and accessed, all major approvals were met, so I would guess its not a big deal, maybe related to the ongoing maintenance payment schedule and when it stops and turns into a lease payment or the like.
The lease agreement was conditional on the plant working to spec during commissioning, but when commissioning is complete re the plant working to spec is subject to interpretation.
So some definition of what constitutes what or the grace to meet spec after commissioning is a likely.
I have faith in the plant it already proved to work at 97% recovery rate with Coyote ore.
