Agree on that TJ, and impact on the next year’s earnings is a real possibility if they lose and have to cover expensive legal costs also.
Looks to me like the adjudication process before the Statutory BCIPA is similar to commercial mediation but with an arbitor who adjudicated in MMM’s favour. Not sure if the Supreme Ct of Qld will apply the same standards as the BCIPA and that could be a problem for MMM if WICET’s comments are correct.
