A capital raising above the market price is a possibility and not unheard of. I hold XRO which had a cap raise just a few months ago at a premium price of $20, at a time when it was trading at around $15.
I would not be surprised if they have the announcement with Philips lined up for September or early October so they can then cut a better deal as they get to the November deadline to finalise the acquisition.
