The wording of those statements is very precise - while the board has probably intended/discussed doing a CR they haven't decided on it. and so they can get away with some of these statements.
From a moral point of view there is a whole school of thought around making these statements without lying - a can't remember the name off the top of my head.
To the lay person what appears as purely misleading statement is technically an accurate statement at the time it was made.
