The application for stay will almost certainly be granted; In 2015, ASQA's batting 2-1at the AAT, with one stay pending for eventual AAT resolution, but its ASQA 1 -1 for substantive hearings, which is a significant improvement for ASQA over previous years.
On a positive note for ACO, two periods of allegedly failed resolution to non-compliance could mean nothing if compliance is demonstrated at time of hearing. So I would swing towards ACO winning the AAT round eventually.
Could all be a hollow victory though, as there's still the ACCC and reputational issues to be dealt with.
