Thanks vestro. Its much bigger than S&G though, people in UK are being conned by a politically motivated gesture that will not deliver the result. The rallying call is cheaper premiums through weeding out false claims.
This will turn into a social issue and when people twig on that the governement are attempting to fool them into believing it is a good thing through cheaper insurance they will arc up. This is an attack on people's right to compensation for injuries and if there is a winner it will be insurers. It is little more than a tax where an attempt to reduce costs is offset by an increase in government tax on premiums.
The UK government surprisingly got up,at the last election, largely due to a weak opposition. They will face one almighty fight if they wish to take on the people. Typical of government I'll thought out ideas are thrown out there under an umbrella of improving cost of living (through cheaper insurance).
Insurers understand injury is part of a valid claim and this pose with good underwriting practice can work with their actuaries to price it correctly. Fraud creates havoc on normal modelling, that is all they want - remove fraud in claims.
That is exactly what responsible companies like Slater and Gordon want to. Remove fraud. That is why sophisticated selection criteria and knowledge can weed out fraud before it goes down the path. Slaters (and other responsible UK PI legal practice) working closely with Insurers, all on the same page wil produce the result.
All this proposal does is try and con genuine claimants out of pursuing a claim through ignorance. Don't know how to claim, all too hard, so I won't. That is no way to run a fair society, when the people latch on to this there will be uprising across the cities and towns.
This proposal will be watered down, there will be compromise on all sides. The net result will be a firm commitment through affirmative active for notification of first loss (SGS and similar) to have sophisticated fraud detection in place. The insurers will welcom that and everyone will be happy. The courts serve their purpose, people are represented and insurers are able to price their policies with confidence.
