THE long standing mining battle between mining giants SMM Solomons (Sumitomo) and Axiom is finally over.
In their ruling today, the Court of Appeal has finally upheld the initial ruling in favour of Axiom, by upholding the appeal points raised by appellant SMM Solomons Ltd.
The two mining firms have engaged in a long-drawn legal battle over mining rights on Isabel, which ended in the High Court late 2014, when Justice John Brown ruled in favour of Axiom only to be appealed by Sumitomo after making a detailed analysis of the decision.
Chief Justice Sir Albert Palmer earlier described this court case and the Town Ground Plaza case as the most expensive because expatriate judges were engaged.
