The regulatory requirement is to "demonstrate the essential requirements of safety and performance have been achieved".
Demonstrating safety alone is, in my experience, very unlikely to suffice. The regulators simply favour approved devices over unapproved devices for which performance has not been scientifically proven via RCT.
The Aus CT / IDE results, if successful, could potentially facilitate the CE approval process.
